SMK APARAT MAKINA  LTD.ŞTİ., we show maximum sensitivity to the security of your personal data. Your personal data is processed and stored in accordance with the Law on Protection of Personal Data No. 6698 ("KVKK").

1. How Your Personal Data May be Processed

In accordance with Law No. 6698 KVKK, your personal data shared with smkmakina.com.tr may be processed in whole or in part, automatically or non-automatically, provided that they are part of any data recording system, obtained, recorded, stored, altered, reorganized, briefly, processed by us for any kind of transaction performed on the data. Any process performed on the data is considered as "processing of personal data" within the scope of KVKK.

2. Purposes and Legal Grounds for Processing Your Personal Data

The personal data you share are processed for:

• To fulfill the requirements of the services we provide to our customers, to be able to perform in accordance with the contract and the requirements of technology, and to improve the products and services offered;
• To provide information to prosecutors, courts, and relevant public officials upon request and in accordance with the legislation, in matters concerning public security and legal disputes;
• To provide our members with a wide range of opportunities and to share these opportunities within the legal framework with individuals or institutions that can provide these opportunities;
• For analyzing advertising preferences;

in compliance with Law No. 6698 KVKK and related secondary regulations.

3. Information Regarding Third Parties to Whom Your Personal Data May be Transferred

For the purposes stated above, the individuals/organizations to whom your personal data shared with smkmakina.com.tr may be transferred include our main shareholders, our shareholders, advertisers, direct or indirect domestic/foreign subsidiaries, in particular member companies using the smkmakina.com.tr infrastructure, and limited to them, individuals and organizations related to the service provided; organizations we receive services from as a Data Processor, organizations we cooperate with, program partner organizations, domestic/foreign organizations, and other third parties and organizations.

4. How Your Personal Data is Collected

Your personal data is collected:

• Through forms on the smkmakina.com.tr website and mobile applications, including information such as name, surname, address, phone number, work or personal email address; preferences on pages accessed by using username and password, IP records of transactions, cookie data collected by the browser, and navigation details;
• Through physical or virtual means, face-to-face or remote, oral or written, or electronically, from individuals who share their personal data with smkmakina.com.tr for purposes such as establishing commercial relations, applying for a job, submitting bids, and similar ways, including business cards, resumes (CVs), submitting bids, and other ways;
• In addition, data obtained indirectly through different channels, from (micro) websites used for various purposes such as websites, blogs, contests, surveys, games, campaigns, and similar purposes, social media, publicly available data provided by databases, publicly shared profiles and data from social sharing sites such as social media platforms (Facebook, Twitter, Google, Instagram, Snapchat, etc.); can be processed and collected.

5. Personal Data Obtained Before the Enforcement of KVKK

Since smkmakina.com.tr did not start its publication before the enforcement date of KVKK on April 7, 2016, there is no personal data stored before this date.

6. Transfer of Your Personal Data

Your personal data collected by any of the methods mentioned above may be transferred to service providers located abroad (countries where the Personal Data Protection Board accredited and where there is adequate protection for personal data) in compliance with KVKK and for the purposes of carrying out our activities and/or as a Data Processor, and to individuals and organizations related to the service provided.

Your Personal Data may be transferred to:

• Our business partners with whom we cooperate to provide and promote products and services;
• Authorized authorities to determine your location in case of emergency;
• Regulatory and supervisory institutions, courts and enforcement offices, and other public institutions or organizations authorized to request personal data;
• Legal persons with whom smkmakina.com.tr has a commercial relationship and who have your phone number, when deemed necessary.

7. Storage and Protection of Personal Data

smkmakina.com.tr is obliged to take software measures such as hashing, encryption, transaction logging, access management, and physical security measures to prevent the unlawful processing of personal data, prevent unauthorized access; to ensure their storage in accordance with Law No. 12 of KVKK. In case it is learned that personal data has been obtained by unlawful means, the situation will be reported to the Personal Data Protection Board immediately, in accordance with the legal regulations and in writing.

8. Maintenance of Accurate and Up-to-Date Personal Data

According to Article 4 of KVKK, smkmakina.com.tr is obliged to keep your personal data accurate and up-to-date. In this context, in order for smkmakina.com.tr to fulfill its obligations arising from the current legislation, our members are required to share or update their accurate and up-to-date data through the website/mobile application.

9. Rights of the Personal Data Subject under Law No. 6698 KVKK

In accordance with Article 11 of Law No. 6698 KVKK, which entered into force on October 7, 2016, the rights of the Data Subject are as follows:

• The Data Subject may apply to smkmakina.com.tr (data controller) and request to learn about;
• Whether personal data is processed;
• Request information if personal data has been processed;
• The purpose of processing personal data and whether they are used in accordance with their purpose;
• Knowing the third parties to whom personal data is transferred domestically or abroad;
• Requesting correction if personal data is incomplete or incorrect;
• Requesting deletion or destruction of personal data within the framework of the conditions specified in Article 7 of KVKK;
• Requesting notification to third parties to whom personal data is transferred, in case of correction, deletion, or destruction of personal data;
• Objecting to the emergence of a result against the person by analyzing the processed data exclusively through automated systems;
• Requesting compensation in case of damage due to unlawful processing of personal data.

smkmakina.com.tr may respond to requests, positive/negative responses, in written or digital form, provided that they are effective and within 30 days. The necessary processes regarding the requests are free of charge. However, in case there is a cost for the processes, smkmakina.com.tr reserves the right to request a fee. These fees are determined based on the tariff determined by the Personal Data Protection Board, in accordance with Article 13 of the Law on the Protection of Personal Data.

By sharing your personal data on our website, applications, and other channels and accepting our Personal Data Policy and the terms regarding processing, processing methods, transfer, sale, and other relevant issues in our policy, and that your data may be shared with third parties for commercial purposes, provided that it is beneficial to members, and that you will apply to smkmakina.com.tr before exercising your legal rights, you declare that you accept with an explicit consent, defined as being informed, based on a certain subject, and expressed with free will.
